A short but very compelling essay on the topic of sexual consent that has lately taken up the European legal and public debates.
Clara Serra contextualizes the roots of the issue in the feminist sex wars of the second part of twentieth-century America, which saw debates between theorists like Catharine MacKinnon who argued that consent was materially impossible given the male domination on women, and the liberal-oriented idea of consent as just another form of contract ratified with a simple "yes."
Serra draws from these two intellectual currents to give a definition of consent, that she distinguishes from desire. Following Judith Butler's remarks that sexuality must always be contextualized, she argues that is not a "yes" or "no" that constitutes consent but the possibility thereof of sharing and revoking these thoughts at any given moment. If a "only yes means yes" law would pass, it would give tremendous power to the State to codify what constitutes "good" and "bad" sex, which will be more harmful than a so-called legislative lack of clarity.
Eventually, the author advocates for a right to not knowing and to explore our desires, and to explore them outside of legal frameworks. Even more importantly, she warns us against the looming trap of carceral feminism, which not only will not help women but also harm other vulnerable population.
